Even then, piracy didn’t stop. Movies are being brought on the social media platform within a week of release. There are situations where the movie was made available even before the release date. For these reasons, the Indian government has planned to take some actions against piracy.

The Copyright Act, 1957:
According to “The Copyright Act, 1957″,
The court said that, when one attempts to commit the crime of piracy i.e. when one tries to watch or download movies online, a warning should be displayed on the screen. The anti-piracy warning text states “This URL has been blocked following the government orders.
The unauthorized or illegal reproduction, duplication, distribution of content in any form (audio, video, written) from this URL shall be considered as a crime. Any person trying to attempt for this crime shall be subjected to fine imposition and imprisonment”. So, whenever a person tries to download any movie online illegally, then a warning is issued in order for the person to realise he is committing a crime. If he does not pay any heed to these warnings, then action will be taken against him.
The Cinematograph Amendment Bill, 2019:
In the year 2019, an amendment was made to the Cinematograph Act, 1952. This amendment of this bill aims to stop acts of piracy. The amended bill has two purposes:
· To make piracy illegal.
· Punish the culprit for the same.
The amendment made to the Cinematograph Act, 1952 is nothing but the inclusion of section 6AA. According to this new section in the Cinematograph Amendment Bill, 2019, a person who does unauthorized recording or shooting or videos of the movies in theatres shall be subjected to imprisonment of at least 3 years and a fine shall be imposed which may extend up to 10 lakhs approximately. This amendment will help the industry in boosting up their revenues and preventing losses that usually occur because of piracy.
Now, comes another question that if one visits the website that has been blocked, will that be considered as a crime? The answer is NO. If a person merely visits the website accidentally or randomly, that would not be considered as a crime. No case will be filed on that and there would be neither fine nor jail imprisonment.
Unfortunately, in India, not many cases are filed regarding piracy. This is because of the inability to find out the root cause i.e. the first person who actually started it. Whenever a new movie is pirated, the producers or the government gets the website blocked. The pirated website creates extensions for those websites and again produces the new movie online. This is what actually happens.
Because of the inability to identify the root cause, the producers or the owners of the content do not file a case. Once they file a case regarding piracy against any person, initially they would be warned. If the same thing is repeated, an FIR would be filed against that person. The police cannot take the person directly to the jail for the first time, according to the orders given the Bombay high court.
Thus, it is concluded that no punishment or fine imposition will be given to the person who randomly reaches the sites blocked by the government. The one who tries to do something wrong at this site shall be punished by the court of law under various sections of the above-mentioned laws.
How can you stop digital piracy?
Digital piracy can lead to loss of revenues. Many challenges come across the way when one tries to stop piracy. The reason why piracy has started is that users wanted to watch absolutely free of cost. They don’t want to spend money. The other thing why piracy is unstoppable because its proliferation among the public is being done very easily. Apart from this, advanced technology has enabled people to master in hacking systems. Thus, piracy has become unstoppable.

· Implementation of streaming services:
People will definitely understand that paying for streaming services and watching the movie legally without any risks is far better than watching movies illegally. These websites also constitute movies, TV shows, serials, games, etc. But, unlike pirated websites, these streaming websites are legal. Thus, by enhancing the streaming services, digital piracy can slowly be brought to an end.
· Preventing piracy through laws:
There should be a governing body that can keep an eye on piracy. Enactment of laws is not sufficient to stop digital piracy. A governing body should be present who constantly keeps a check of piracy activities.
Preventing piracy through technology:
1. Forensic Watermarking:
A watermark enables one to easily detect piracy. The watermark can be added to contents like written documents like pdfs, word files, videos, etc. By checking for the watermark, one can easily identify whether the complete content has been pirated or only part of it has been pirated.
2. Fingerprinting:
Just like humans have different fingerprints, the content also has unique fingerprints. Using fingerprints, one can identify whether their content has been pirated or not. When a person tries to upload pirated content, the content will be checked for its fingerprint. If the fingerprint doesn’t match with the database, it will be detected as pirated content and will be blocked by the system. This is how fingerprinting technology works.
Fingerprinting and watermarking are two entirely different technologies. It has to be noted that watermarking requires the insertion of identifiable marks unlike fingerprinting. Fingerprints of the content are itself a unique identity and do not require insertion of any other marks into the content.
3. Digital rights management:
DRM is another technology that can effectively prevent piracy. This system gives an embedded code to the content. Whenever a person tries to download the content, the code will not allow him to do so. Even if it gets downloaded, the person will be able to view it only on the Tonton platform. Other platforms do not support it. Also, one will not be able to share the content because of software encryption. If a person takes a snapshot of the video, it will appear as black. All these features of DRM are workable solutions in preventing digital piracy.
