Introduction

What is the government doing to stop piracy?
The Rajya Sabha of India passed a bill under the name “Cinematograph Act, 1952” which imposed strict actions to be taken against this illegal practice being followed in India. According to this act, if there is illegal duplication or reproduction of the film then the convict is set to have jail imprisonment. When a movie is pirated, the producer ends up losing a huge amount of money and to prevent this, such an act has been passed by the government of India.
The government of India considered this and passed an amendment act were in under sections 63, 63-A, 65 and 65-A of the Copyright Act, 1957 if you are caught practicing this unlawful act or caught supporting this fallacy then you can be imprisoned from 6 months to 3 years and have to pay the fine from Rs.50,00 to Rs.200,000 when caught for the first time. If an individual is charged with piracy violation cases for the second time then a fine of 100,000 to 200,000 has to be paid along with an extended jail time of 1 to 3 years.
What will happen if I download movies Illegally in India?
Udta Punjab, And Tera Kya Hoga Johnny, Mohalla Assi, Paanch have one thing in common. All these movies were leaked before its release date. The full-length copy of these movies was already on the pirated websites before they got released in the theatres. The cruel part is movies like paanch and Mohalla Assi never got released in the theatre and you can still find them online.
Here we will see in detail, why this is happening and what are its consequences.
Back in the 90s, a person did not have many sources to consume data. The Internet was not so preferable and affordable, everyone depended on their television system to display their favorite shows and movies. Let us take an example if you want to watch a tv show like “Byomkesh Bakshi”. You either wait weekly to see its telecast on the cable network or you buy the DVD’s which were present in the physical market but during that time such DVD’s were very expensive and not every person could afford it. That’s when Torrent came into the market and changed the whole system. Torrent would allow people to have their favorite tv shows in their system with nothing but an internet connection. All the episodes were available and neither you had to spend money, nor you had to wait weekly for each episode to air on the cable network. Torrent had numerous websites on it which would provide all types of movies, tv shows, documentaries, music, etc globally and it was flexible since it provided dubbed content as well.
Though this whole practice was illegal, dangerous (since these torrent sites have various viruses like malware which could harm your system) and it is punishable by the law, the people still found it very useful because who wouldn’t want to save a few bucks and watch their favorite tv show or movies for free within a few days. Later on when the movie producers started finding it difficult because when their original content is pirated it immensely affects their sales and that leads them to face losses even after spending so much money in the production of these movies and shows.
Sites like pirate bay are said to be freely licensed which means that the site has the permission of the owner to download, stream and share content freely. But the content on these websites is unauthorized and has protected copyrights by the actual owner so if you think that downloading and watching new movies in its first week of release is illegal, then yes, it is! Ethically no producer will allow one to violate their content and whatever is posted on these torrent websites is highly unlawful and illegal.
Apart from the conventional copyright act, there are also other acts and rules which are largely overlooked by people and they can majorly damage a person if they were found doing piracy or supporting piracy in any form. The Information Technology Act supervises and finds out the unauthorized illegal use of computer networks like VPN which are largely used to download from pirated sites. Data that is duplicated and reproduced from that system to an external device comes under piracy.
Through the trademark act, an identification mark is put on your content which shows that it is owned and copyrighted by an individual and stealing it would be against the law. The universal symbol of (TM or ®) is used. stealing this content is dangerous and if the producer files a complaint he/she will get legal remedies from the officials.
How can you stop digital piracy?
With the rise of broadband Internet access and low prices as well as the evolution of technology digital piracy is thriving. Digital piracy can not completely vanish but it can be reduced on a large scale. To make this happen different methods need to be used as the basic education of the viewers, a gamut of technological solutions and lastly a little harsh one like the law enforcement that leads to imprisonment. Now, to affect the behavior of people socially various sites have now started streaming limited amounts of free content and charges are being deduced which makes the person approach legal means and skip illegal means. For example, companies like Spotify and Hulu which are highly reputed and provide the best quality content are now streaming its major content for free and a certain amount is prescribed for premium content which is also quite affordable by the local crowd.
Apart from this, technical controls include content management, DRM- Digital rights management which prevents the sites to use your content illegally and enforces licensing to the unauthorized use of duplicated content. Network management technique is also one of the preventive measures which include traffic shaping and bit caps. This way piracy can be reduced along with reducing the load of broadband internet which will eventually improve the quality of the network and provide services at lower prices.
Today, content owners have started sending notices to online users regarding the infringement of copyright and if they are found to be doing so they will be responsible for their own actions and serious consequences will be faced by them. Apart from this, the government has also been taking serious steps forward to reduce digital piracy. With the various laws and enforcement, the government should also start supporting technological solutions. The government has imposed various restrictions on technological innovations like network management and content identification and filtering which would actually help in reducing digital piracy. Removal of such restrictions can be fruitful and alongside the government also needs to coordinate with companies and producers to fight piracy.
Conclusion:
Although today we live in a streaming world where a huge amount of population streams millions of shows/movies every single day, there are high chances that some part of it is not doing it legally and approaching torrent websites despite all the dangers that come with it. There are a lot of people who used to be viewers of these sites but after being educated by the illegal activities, they started using legal streaming sites. This way by using other precautionary methods, piracy can be something that we can overcome but in the long run. Today’s conventional world is still very much using these pirated websites and the government as well as corporations are trying their best to foreshorten that number as much as feasible.
